A Collier County couple turns the tables on Bank of America, the bank that tried to foreclose on their home. Now, the family is foreclosing on the bank!
Even bringing trucks and deputies ready to seize property.

The foreclosure nightmare started when Warren and Maureen Nyerges paid cash for a home owned by Bank of American in the Golden Gate Estates. They never had a mortgage whatsoever. But, the bank fouled it up and wound up issuing a foreclosure through their attorney.

The couple took their case to court and after a year and a half nightmare the foreclosure was dropped. A Collier County judge said Bank of America has to pay the couple's $2,534 legal fees for the error. After more than five months the bank still hadn't paid up. So, the homeowners' attorney did just what the bank would do to get their money, legally seize their assets.

"I instructed the deputy to go in and take desks, computers, copiers, filing cabinets, including cash in the drawers," Attorney Todd Allen told WINK News.

Outside the Bank of America on Davis Boulevard, several deputies stood by with movers ready to start hauling out the bank's office supplies and furniture.

Inside, the homeowners' attorney was locked out of the bank manager's office by deputies while the bank manger tried to figure out what to do.

Allen says the manager was visibly shaken, "Having two Sheriff's deputies sitting across your desk, and a lawyer standing behind them, demanding whatever assets are in the bank can be intimidating. But, so is having your home foreclosed on when it wasn't right."

After about an hour the bank finally cut a check to satisfy the debt, and no furniture was taken. A representative for Bank of America issued a statement saying they are sorry for the delay in issuing funds. They claim the original request went to an outside attorney who is no longer in business.

As for Allen, he calls this a symptom of a larger problem he sees often in the courts, where banks don't perform their due diligence on foreclosure cases. "As a foreclosure defense attorney this is sweet justice."

Man's 'pants' password is changed

A man who chose "Lloyds is pants" as his telephone banking password said he found it had been changed by a member of staff to "no it's not".

Steve Jetley, from Shrewsbury, said he chose the password after falling out with Lloyds TSB over insurance that came free with an account.

He said he was then banned from changing it back or to another password of "Barclays is better".

The bank apologised and said the staff member no longer worked there.

Mr Jetley said he first realised his security password had been changed when a call centre staff member told him his code word did not match with the one on the computer.

"I thought it was actually quite a funny response," he said.

"But what really incensed me was when I was told I could not change it back to 'Lloyds is pants' because they said it was not appropriate.

"I asked if it was 'pants' they didn't like, and would 'Lloyds is rubbish' do? But they didn't think so.

"So I tried 'Barclays is better' and that didn't go down too well either.

"The rules seemed to change, and they told me it had to be one word, so I tried 'censorship', but they didn't like that, and then said it had to be no more than six letters long."

Mr Jetley said he was still trying to find a suitable password which met the conditions.

He said his dispute with the bank started over some travel insurance, but that issue had been dealt with by managers independently.

A statement released by the bank said: "We would like to apologise to Mr Jetley.

"It is very disappointing that he felt the need to express his upset with our service in this way. Customers can have any password they choose and it is not our policy to allow staff to change the password without the customer's permission.

"The member of staff involved no longer works for Lloyds TSB."

Rottweiler fights dog to save boy

A South African Rottweiler has helped rescue a two-year-old boy who was being mauled by a pit bull terrier.

The pit bull attacked Tshepang Taeli as he was walking with his grandmother in Oakdene, south of Johannesburg.

The dog was dragging the toddler down the road and would not let go, despite being kicked and beaten by residents.

One of the neighbours, Ricky Veludo, came to help and then went to fetch his dog, Blade. "He fought the other dog to free the child," he told a local paper.

"Blade is very protective," Mr Veludo told Die Beeld newspaper.

The boy was then rushed to hospital where he is recovering from bites to his face, legs and stomach.

"I have never felt so much pain in my life. The dog was attacking him and I was trying to release him and I could not," the boy's grandmother told The Star newspaper.

Police have opened an investigation into the attack.

Pit bulls were originally bred for bull-baiting and are noted for their ferocity.

Rottweilers were not bred for fighting but gained a notorious reputation after being used in The Omen films.

Space Virus

A computer virus is alive and well on the International Space Station (ISS).

Nasa has confirmed that laptops carried to the ISS in July were infected with a virus known as Gammima.AG.

The worm was first detected on earth in August 2007 and lurks on infected machines waiting to steal login names for popular online games.

Nasa said it was not the first time computer viruses had travelled into space and it was investigating how the machines were infected.

Orbital outbreak

Space news website SpaceRef broke the story about the virus on the laptops that astronauts took to the ISS.

Nasa told SpaceRef that no command or control systems of the ISS were at risk from the malicious program.

The laptops infected with the virus were used to run nutritional programs and let the astronauts periodically send e-mail back to Earth.

The laptops carried by astronauts reportedly do not have any anti-virus software on them to prevent infection.

Once it has scooped up passwords and login names the Gammima.AG worm virus tries to send them back to a central server. It targets a total of 10 games most of which are popular in the Far East such as Maple Story, HuangYi Online and Talesweaver.

Nasa is working with partners on the ISS to find out how the virus got on to the laptop in the first place.

The ISS has no direct net connection and all data traffic travelling from the ground to the spacecraft is scanned before being transmitted.

It is thought that the virus might have travelled via a flash or USB drive owned by an astronaut and taken into space.

The space agency also plans to put in place security systems to stop such incidents happening in the future.

Nasa told Wired News that viruses had infected laptops taken to the ISS on several occasions but the outbreaks always only been a "nuisance".

Chinese faked Olympic opening ceremony

Chinese officials have admitted faking parts of the opening ceremony for the Beijing Olympics.

In fact they have gone one better than admitting it and are now even boasting about fooling people.

Millions of viewers worldwide watched in awe as a series of 29 fireworks appeared to be set off to show giant footprints in the sky running to the national stadium.

But bosses have now revealed the images which were shown as though live were in fact filmed over a period of 12 months.

"Most of the audience thought it was filmed live - so that was mission accomplished," Gao Xiaolong, head of the visual effects team for the ceremony boasted in the Beijing Times.

Postmen want legal protection from dogs

Postmen in the UK want legal protection from dogs, say the Trade Union that represents them.

While images of dogs chasing postmen have been a comedy staple for years, the Communication Workers Union say it is no laughing matter.

Last year almost 6,000 posties were attacked by a dog as they tried to deliver letters, some seriously and even hospitalized.

But a loophole in the law means they have no protection under the Dangerous Dogs Act which only covers public places.

This means owners cannot be held accountable for their animals actions though the same attacks could send them to prison if it happened on a public street.

Little Gordon Ramsay is F'ing popular

A miniature Gordon Ramsey has become a surprise Internet hit by mocking the TV chef and his four-letter rants.

A clip of the youngster blasting the quality of the lunch his mother has prepared - peppered with the F word - has been watched over 60,000 times on YouTube.

In the on-line ad little Gordon shouts "What the f**ks in here, it's f**king embarrassing" before tipping his lunchbox out onto the kitchen table.

As his mother walks out crying he shouts after her: "That's right here come the waterworks, that's going to help."

Hospitality group Caterer.com who recruit would-be chefs say the advert is the first of a upcoming series.
